Polemik dugaan pemalsuan perubahan Akte akan berujung laporan hukum. Dilansir dari progresif jaya Saksi oknum salah satu penegak hukum mengetahui adanya kejanggalan dalam proses penerbitan akte perubahan yang diduga palsu, namun membiarkan/mendiamkan saja. Ada apa ?

Saksi Fernando Silalahi berprofesi sebagai pengacara, juga Dosen di Universitas Kristen Indonesia, bahkan menjabat juga sebagai Direktur di PT. Quantum terancam dilaporkan Tim Penasehat hukum dari Pos Bantuan Hukum – Universitas Kristen Indonesia (PBH – UKI).

Pasalnya, saksi Fernando Silalahi dalam memberikan kesaksian seperti menutup – nutupi perbuatan jahat yang diketahuinya kebenaran yang sebenarnya, bahkan terkesan melakukan pembiaran atas perbuatan jahat terkait dugaan tindak pidana pemalsuan akte perubahan.

“Ya, pak ! Kami akan laporkan ! Setidaknya kami tahu ada beberapa keterangan yang memang tidak benar,” kata Friska JM Gultom salah seorang dari Tim penasehat hukum dari PBH – UKI didepan majelis hakim pimpinan R. R Kindarto, SH., didampingi Erly Soelistyarini, SH., MHum., dan Togi Pardede, SH., MH., di Pengadilan Negeri (PN) Jakarta Utara, Selasa (19/4-2022).

Sementara Notaris, juga Dosen di UKI dimana saat ini berstatus terdakwa yaitu, Diana Ria Winanti Napitupulu, SH., MH., M.Kn., MSc., dengan tegas membantah keterangan saksi Fernando Silalahi.

“Majelis hakim Yang Mulia ! Keterangan saksi Fernando Silalahi tidak benar ! Saya percaya kepadanya, selain dia rekan sesama Dosen, dia juga seorang pengacara pak David (David Israel Supardi),

Bahkan sebelum penerbitan Akte Perubahan No. 2 kami berbicara melalui telepon dan dikatakannya, bahwa biasanya dalam pembuatan akte perubahan yang ngurus adalah pak David baik undangan dan pemberitaan,” kata terdakwa setelah majelis hakim meminta tanggapannya atas keterangan saksi.

Sebagaimana fakta terungkap, dari sejumlah pertanyaan yang diajukan, baik oleh majelis hakim, Suryani Alawiyah, SH jaksa penuntut umum (JPU) dari Kejati DKI Jakarta didampingi Melda siagian, SH dari Kejari Jakarta Utara.

Tim penasehat hukum dari Pos Bantuan Hukum – Universitas Kristen Indonesia (PBH – UKI), terlihat saksi Fernando Silalahi “angkuh” acuh tak acuh memberikan jawabannya, bahkan tanpa ada rasa empati kepada rekannya sesama Dosen.

Selain itu, saksi sangat percaya diri bahwa dirinya tidak terlibat sama sekali atas perkara yang menimpa rekannya.

Padahal diketahui dari dakwaan jaksa, baik perkara atas nama terdakwa yang telah divonis yang tidak lain adalah ‘bos’ nya yakni, David sebagai Komisaris dan Direktur beberapa perusahaan adalah atas suruhannya yang diperintahkan David.

“Kami minta kejujuran saudara saksi ! Dua Minggu sebelum diterbitkan akte perubahan No. 2, saudara melalui telepon mengadakan pembicaraan kepada klien kami ! Benarkah demikian,” tanya Tim penasehat hukum.

“Ngga ingat,” jawab Fernando Silalahi samar – samar, bagaikan semilir angin yang nyaris tidak kedengaran.

“Anda seorang Lawyer, Dosen dan menjabat lagi seorang direktur. Pernah ngga saudara bertelepon dengan Diana dan mengatakan, “biasanya dalam pembuatan akte perubahan yang ngurus adalah pak David,” cecar Tim penasehat hukum kembali.

“Saya tidak pernah,” jawabnya singkat masih dengan nada semilir tertiup angin.

Ditambahkannya, dirinya tidak pernah dengar ada proyek PT. Fuji dan tidak pernah menerima surat tembusan atau kiriman ke email terkait dokumen – dokumen PT. Sumber Sentosa Cemerlang (PT. SSC), baik dari David dan dari Notaris.

“Apa yang anda tandatangani di halaman parkir kantor itu, apakah akte pendirian PT. Quantum atau risalah rapat PT. Quantum. Saya minta saudara jawab yang jujur, anda telah disumpah,” cecar Friska JM Gultom salah satu dari Tim penasehat hukum.

Dimana terlihat, Fernando Silalahi seorang pengacara dan Dosen di UKI bahkan menjabat direktur di PT. Quantum terdiam dan tidak dapat menjawab, bahkan angin semilir telah berlalu.

Saksi Fernando Silalahi berprofesi pengacara dan Dosen di UKI, “Saya kira ngga perlu diingatkan dia sudah disumpah ! Kalau saudara memang sudah tahu dia menjawab tidak benar atau tidak jujur.

Laporkan memberikan keterangan palsu,” ingatkan majelis hakim menengahi kebungkaman saksi yang terdiam tidak dapat menjawab pertanyaan Tim penasehat hukum.

“Ya, pak ! Kami akan laporkan ! Setidaknya kami tahu ada jawaban saksi yang tidak bisa dipertanggungjawabkan, hingga menjerumuskan klien kami, padahal dia tahu klien kami single parents,” ujar Friska menanggapi peringatan majelis hakim.

Sekedar info diketahui, atas keterlibatan Notaris Diana Ria Winanti Napitupulu dalam proses penerbitan akte perubahan No. 2, No. 3 dan No. 8 yang diduga palsu tersebut adalah atas suruhan Fernando Silalahi yang dimintakan terpidana DIS.

Sebagaimana info dari sumber terpercaya disebut, bahwa antara para pengurus dan pemegang saham disejumlah perusahaan bentukan DIS yang kerap dilakukan pergantian kepengurusannya adalah diduga “main saham”.
